WSC Service Contract for Creative Educational Services & Media Consent
Read the following information concerning creative services. Please sign and submit this document before initially starting services.
The following Terms of Service is an Agreement effective between “WHAT’S SHE CREATING? ENTERPRISES”, and "CLIENT”. The parties mentioned above are legally bound and agree as follows:
Description & Cooperation of Services. What's She Creating Enterprises (WSC) offers Creative Educational Services to Client. WSC agrees to cooperate with client and client’s needs to the full extent of services. What’s She Creating Enterprises represents and warrants to Client that it has the mastery experience and ability to perform the services required by this Agreement; that it will perform said services in a professional, competent, and timely manner; that it has the power to enter into and perform this Agreement; and that its performance of this Agreement shall not infringe upon or violate the rights of any third party or violate any federal, provincial and municipal laws.
Fees and Payment Systems. All services must be paid in full before all services are rendered. Payments are payable website www.whatsshecreating.com , CashApp: $whatsshecreating or Paypal.com.
Refunds and Rescheduling. Client will not be refunded for services. Client may contact whatsshecreating@gmail to reschedule services due to emergencies or illness. WSC deems emergencies on a case by case basis. Emergencies include related death in family, contracting a contagious illness or injury to Client or Client's family members. In this case reschedule of services is appropriate. Client must reach out to Creative Consultant in a timely manner (24 hours before class starts.)
We will gladly offer a credit or rescheduling of services to use toward a future workshop/seminar if notified at least 24 hours before the client’s registered workshop. If client notifies WSC between 0-24 hours before client's registered workshop/session start rescheduling will be cancelled or an additional $30 fee of inconvenience will be added. Fee will need to be paid in order to reschedule next session/workshop. This does not apply to a newly booked session/workshop. Client has up to four months from the time of workshop to reschedule class or forfeit enrollment fee. Please respect the health of others! Do not attend sessions if you are not feeling well. Scheduling. Workshops start on time. Please arrive at least 10 minutes prior to the start time to set up the sewing space. Those arriving 20 minutes after the start of workshop will not be admitted and the enrollment fee will be forfeited. WSC reserves the right to cancel a workshop due to low enrollment. There must be at least two participants in each session. Workshop fees may be transferred to a future session. Supply lists (if needed) are emailed or communicated via text message to clients prior to workshop start date. Clients are responsible for purchasing items on the supply list before the start of class. If client has an issue with item or purchasing, please email whatsshecreating@gmail.com at least 3 days before the start of class to make arrangements.
Equipment Usage. WSC will provide high-quality sewing equipment and tools for Client use. If equipment is broken beyond instructor repair or stolen the Client agrees to pay sewing equipment repair fees of up to $150. If sewing tools are misplaced Client agrees to pay up to $20 for replacement.
Liability. What’s She Creating? Enterprises is not liable for any defects, damage, injury or other incident while using the sewing machine, sewing related equipment, tools or supplies which could cause bodily, mental or emotional harm to the Client on location or location surrounding before, during or after class/workshop/experience.
Child Abuse Policy. Caregivers of children under 17 are required to stay on the premises of the site of participant in program for the entire time of workshop at St. John's Episcopal Church location.
Indemnity. Client will indemnify and hold WSC harmless from any claim, dispute, liability, loss, damage, or demand, including reasonable attorneys’ fees, made by them or any third party due to or arising out of their breach of this Agreement. Client agrees to indemnify, defend and hold WSC and their representatives, agents, contractors, employees, successors and assigns, harmless for any and all liabilities, damages, claims, suits, judgments, costs, fees and expenses that arise as a result of or in connection with the services provided. If WSC brings a legal action to collect any sums due under this Agreement, it shall be entitled to collect, in addition to all damages, its costs of collection, including reasonable attorney's fees. COVID-19 Safety Protocol and Waiver.
Media Consent. What’s She Creating Enterprises may use the participant’s and/or parent/caregiver’s name, photograph, voice, image, and information to be used for its publications, promotional materials, social networks, and website, without compensation and without prior notice. Participant and/or Parent/Caregiver also agrees to be interviewed by the media on site or at related events. Participant and/or Parent/Caregiver releases and holds What’s She Creating Enterprises harmless from any liability stemming from the use of their name, photograph, voice, image, or information.
While participating in events held or sponsored by WSC, consistent with CDC guidelines, participants are encouraged to practice hand hygiene, “social distancing” and wear face coverings to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-toperson contact, WSC has put in place preventative measures to reduce the spread of COVID-19. However, WSC cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19. I assume risk and fully release, waive all claims and liability to the extent of law if infected with COVID-19 while on the premises for sewing instruction.
- Masks are PREFERRED during creative sessions. We will provide hand sanitizer at all events. We will sanitize all surfaces using disinfectant wipes before and after use. We will ensure windows or doors stay open if possible for adequate ventilation.
If a Client is not feeling well before services are rendered please reach out to Creative Consultant. Classes may be rescheduled. Health and safety are first priority!
